General Cans From Fans Contest Rules
The Short version:
You have 15 days to claim your prize. You can not be an employee or family member of an employee of Cans Form Fans or its donating sponsors. If you break it, lose it or hurt yourself with it — it isn’t our fault, and you may be required to pay taxes on prizes depending on your local and state tax guidelines.
The Long Version:
Prize
No prizes are redeemable for cash. Cans From Fans™ reserves the right, in its sole discretion, to substitute any prize with one of equal or greater value. Winners may not request prize substitution. Prizes are non-transferable and may not be claimed or used by any person other than the winner. Unless otherwise stated in the specific contest rules, any prize won will not be mailed under any circumstances and winners must claim their prizes in person at the Cans From Fans™ offices at: 1756 Lakeshore Dr., Muskegon MI, 49441 – 231-759-3160, Monday through Friday between the hours of 8:00am and 5:00pm (excluding holidays and the day before or after a holiday) within 15 days after the end of the contest. Prizes not claimed within the stated period will be forfeited.
Eligibility
Unless otherwise stated in the specific contest rules, all entrants must be legal residents of the United States. A winner will be disqualified if he/she or a member of his/her household has won a Cans From Fans™ contest with a value over $50.00 within the previous 120 days.
Winners and members of their households are not eligible to win a second prize from Cans From Fans™ and/or any Cans From Fans™ Media Partner (1) year (i.e., until the day after the one-year anniversary of winning) after winning a $200+ prize. Winners will be disqualified if he/she or a member of his/her household has won a Cans From Fans™ prize valued at Five-Hundred ($500.00) or greater in the past 365 days.
Employees (including their immediate families and members of the same household) of Cans From Fans™ or its affiliates, promotional sponsors, advertising and promotional agencies who do business with Cans From Fans™ or any of the promotion sponsors, and other radio stations in Cans From Fans™ ADI (as defined by Arbitron) are not eligible to participate in any contest presented by Cans From Fans™. The term “immediate family” includes spouses, siblings, parents and legal guardians, children and legal wards, grandparents, and grandchildren, including “in-laws.” One entry per donation, per day. No purchase or other consideration is necessary to participate. Void where prohibited.
Release
Winners agree to release and hold harmless Cans From Fans™, the promotion sponsors, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability and any injuries, loss or damage of any kind arising from or in connection with this contest and any prize won. Winners (and their guests, if any) will be required to sign a form releasing Cans From Fans™ and its affiliated companies from all liability in connection with the contest and the award and use of the prize before claiming the prize.
Disclaimer
Cans From Fans™ undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of the prize(s) awarded, for any failure to perform or negligent performance of any service provider, or for any other risk, incident or damage, direct or indirect, relating to or arising out of the contest, including (but not limited to) cancellations, postponements, delays or other scheduling changes; missed events or connections or inability of winner to attend; and accident, injury, death, damage or expense arising from or occurring during the use of the prize, or travel to/from or attendance at or participation in any event relating to the contest, by the winner and/or winner’s guest(s). Cash prizes may be fulfilled via company check, or an alternate form of payment (i.e. Gift Cards from a credit card provider). Cans From Fans™ is not responsible for damage to a prize or loss of a prize after the prize has been claimed. Cans From Fans™ is not responsible for technical, hardware or software failure or malfunctions, lost or unavailable network or other telecommunications connections, or lost, late, damaged, illegible, inaccurate, incomplete, garbled, disconnected, or delayed contest entries or communications, whether caused by the sender or by any of the equipment or programming associated with or used in this contest, or by any human error which may occur in the execution of this contest.
License
Entry into any contest constitutes full permission for Cans From Fans™ and promotion sponsors and their respective affiliates to broadcast and/or to photograph or publish the participant’s name, voice, recorded comments, any audio/video portion of the participant’s entry, biographical information, face and likeness without compensation.
Taxes
Cans From Fans™ may be required to report the total value of each prize to the IRS and furnish winners with a federal Form 1099 in which case winners must provide their social security number to Cans From Fans™ for tax reporting purposes, and are solely responsible for payment of all taxes incurred as a result of the award of a prize.
General
All contest entries will become the property of Cans From Fans™ and will not be acknowledged or returned. Failure to conform to all contest rules, or any fraud or other illegal or inappropriate conduct on the part of a contestant, will result in the contestant’s disqualification and forfeiture of any prize won. Cans From Fans™ reserves the right to rule ineligible anyone who, in Cans From Fans™ sole judgment, engage in abusive conduct with respect to any contest or promotion conducted byCans From Fans™ or its affiliates. Cans From Fans™ reserves the right to make changes in the contest rules at any time, which changes will become effective upon announcement. By taking part in a Cans From Fans™ contest, participants agree to be bound by all contest rules and all decisions of the judges, who are employees of Cans From Fans™ and whose decisions with respect to all aspects of the contest are final and binding.
